Serious Gaithersburg Pedestrian Accident Noted By Montgomery County Accident Attorney

A two-car crash in Gaithersburg also involved two pedestrians on a sidewalk. Montgomery County Police have initially blamed excessive speed for the collision and subsequent loss of life that occurred in the afternoon of Friday, Jan. 24.
Collision at a Lane Merge
A Chrysler Sebring carrying two passengers and a Honda Accord reportedly made contact where two lanes merge into one on Muncaster Mill Road, a little past Shady Grove Road. After the cars collided, the Accord went off the road where it struck a utility pole. The Sebring also left the road and went onto a sidewalk where it hit two pedestrians. The vehicle then hit a tree and came to a stop.
The County Fire and Rescue Service dispatched crews to the scene, and both pedestrians were taken to a local hospital. There, one patient was stabilized after receiving treatment for injuries, and that individual was listed in stable condition later that same day. Physicians worked to save the other individual, but they were unable to do so. The deceased pedestrian was a resident of Washington D.C. There were no initial reports of any injuries to the occupants of the two automobiles.
The investigation of this fatal accident was ongoing, and there were no initial reports of what charges might be filed. Although law enforcement indicated a belief that speeding was a factor in the crash, it was unclear whether one or both cars were believed to be traveling at an excessive speed.
Possible Compensation in Such Cases
In a case like this, evidence of speeding could result in liability claims against one or both of the drivers. The fact that two lanes merge into one where the collision happened suggest that a failure to yield the right of way might also have been a factor. A wrongful death lawsuit might be filed by the survivors of the deceased in a case like this. Compensation may be sought for pain and suffering, loss of companionship and loss of financial support. Also, an attorney for the injured pedestrian might file a lawsuit seeking damages for medical expenses, lost wages, possible long-term rehabilitation costs as well as pain and suffering.
