In Maryland, state law defines aggressive driving as three or more of the following driving behaviors present at the same time:

  • Speeding
  • Passing on the right
  • Following too closely
  • Failure to yield
  • Overtaking and passing
  • Failure to obey a traffic control device

Aggressive Driving and Tragic Crashes

Aggressive driving is present in a significant number of traffic crashes resulting in death or injury. According to the Governors Highway Safety Association, 28 percent of traffic deaths occurred in speed-related crashes in 2014. Excessive speed is a common component of aggressive driving. Other tragic accidents occur when motorists run stop signs, fail to yield the right-of-way or pass when it is unsafe.
